Five hip replacement patients from Chicago who received a DePuy Orthopedics ASR hip implant have filed product liability lawsuits against DePuy Orthopedics accusing DePuy of failing to recall the medical device even though there was mounting evidence that the hip implant device was defective reports ABC 7 News.
Patients with the DePuy ASR hip implant have had complications higher than implants manufactured by other companies. Besides complications such as severe hip pain dislocations and fractures, some patients have had metal poisoning, metallosis, caused when metal-on-metal of the device releases cobalt and chromium ions into the surrounding tissue and blood stream.
The complications require that patients have their hip implant removed and a new device installed. This is called a revision. The outcome of a second surgery is generally not as positive as the first surgery was initially because of necrosis of the surrounding tissue and bone loss.
Though DePuy pledges to compensate patients for the medical co-pays when they have a revision surgery, many patients have sought legal help by filing a product liability lawsuit which asks for damages for an individual’s medical costs, rehabilitation costs, pain and suffering, and loss of income as well as other damages.
