Distractions such as cell phones and headphones increases pedestrian and bicycle accident risk

Cellphone and loud music are a distraction when we’re driving, that’s common knowledge at this point. But there are more people on the road than just drivers, and these pedestrians and cyclists are also prone to distracting gadgets.

This point is reinforced by a new study published in The Journal of Injury Prevention. Researchers from the University of Maryland examined pedestrian-car accident profiles over the last six years, and found that injury rates tripled for people wearing headphones. This alarmed researchers, who noted that it is a limited study but also saw the data as cause for further investigation.

Richard Lichenstein, M.D. was the lead author of the study, and put it this way: "Everybody is aware of the risk of cell phones and texting in automobiles, but I see more and more teens distracted with the latest devices and headphones in their ears.”

Dr. Lichenstein makes a good point, though it’s based on anecdotal evidence. Consider all of the times you’ve seen a young person bumping around the sidewalk or crossing an intersection while looking at a phone and listening to headphones. Lichenstein’s study supports his eye-ball test. Of the 116 reported deaths or injuries that he tracked, the majority of victims were male and younger than 30. Most strikingly, 74 percent of the cases stated that the victim was wearing headphones at the time of the crash.

The primary flaw of the relatively small study was that the source of most of the information came from media reports, which is not the most reliable source. That being the case, researchers were careful not to put too much stock in the specifics of the data, instead presenting the study as a means of highlighting the issue of pedestrian distraction itself.

Just like driving safety, children are taught how to move safely around the streets from a young age. What we learn to look both ways before crossing the street and to always use our ears to inform us of what’s going on around us. More simply, to use our eyes and ears at all times. But handheld devices--and especially devices that engage eyes and ears with headphones—can dramatically impair those senses.

Comparisons have been drawn between distracted and drunk driving. Perhaps an appropriate parallel to distracted walking is public intoxication. But unlike drunk driving, not since prohibition has public intoxication been a hot button national issue. It’s simply hard envision a person walking around on his or her phone ever being viewed as a public evil like distracted driving. That’s because young people like those the study found were more likely to be involved in a headphones-related accident don’t use cellphones as a communication device. It’s a connection to the virtual self where we store information, entertainment and of course our entire social network. But no matter how connected to our devices we become, our bodies stay in the here and now of the physical world, where crosswalks, cars and unexpected dangers remain.

The solution may be as simple as parents and teachers integrating an awareness of just how distracting mp3 players and cell phone applications can be into the routine lessons about looking both ways. As the researches pointed out, a thorough investigation into the dangers that these devices can pose to pedestrians can help us all understand what needs to be done.

Family of pedestrian killed by drunk driver receives $11M wrongful death award

The family of a young man who was struck and killed by a drunk driver has been awarded $11M from a Tennessee jury. The award included $5M in punitive damages. (Citation: Hudson v. Wilcox, No. 26601 (Tenn., Washington Co. Cir. Nov. 18, 2011).)

David Hudson, 27, a small business owner was crossing a street when he was hit by David Wilcox who was allegedly driving while intoxicated and without his headlights on when the pedestrian accident occurred.

David Hudson's estate which includes his parents and siblings filed a wrongful death claim after his death. A wrongful death claim can be filed on the behalf of a loved one who has been killed due to the wrongful or negligent act of another. How To Get the Most From Your Accident Settlement

Fall walking/jogging safety tips for pedestrians

In the past decade, the number of car accident deaths have steadily declined. Unfortunately, that can not be said for pedestrian accidents. Every year, more than 4,000 people are killed in pedestrian accidents and nearly 70,000 pedestrians are injured.

Whether you are running, jogging or walking your dog, you need to be especially careful now that fall is upon us and the days are shorter.

One of the most common sense suggestions for pedestrians is to wear clothes so that you will be seen. A white shirt, a reflective vest and lights made for runners/walkers can help you stay visible. It is amazing the number of pedestrians who just do not make themselves visible.

The National Highway Traffic Safety Administration and the Centers for Disease Control provides the following safety tips for pedestrians:

  • Cross at designated intersections where drivers most expect pedestrians.
  • Pedestrians should be especially careful at intersections. Some drivers may fail to yield or they may fail to notice pedestrians when they make a turn.
  • Avoid crossing freeways or highways as cars travel at high rate of speeds and pedestrians often miscalculate their ability to cross the highway.
  • Do not cross train tracks except at marked railroad crossings and NEVER cross tracks unless barriers are not down.
  • Wear reflective clothing and carry a flashlight.
  • Walk or jog on sidewalks.
  • If there is no sidewalk, walk facing traffic.

Safety tips to avoid car-pedestrian accidents

The Washington State Patrol reports that there have been 7 fatal pedestrian accidents in Southwest Washington in the past 10 months.

The WSP provides the following safety tips for pedestrians to avoid a pedestrian accident:

  1. Do not walk on freeways.
  2. If your vehicle becomes disabled on the freeway, pull to the right as far as possible. Stay in your vehicle if possible. If you exit your car, exit from the passenger side. Avoid standing between two vehicles.
  3. If you have a flat tire on the traffic side of your vehicle, call roadside assistant or 911. The WSP will respond to help you.
  4. If you are involved in a motor vehicle accident, move your vehicle as far right as possible and call 911.
  5. If you are involved in a motor vehicle accident and your car or truck is not drivable, leave your vehicle and move to a safe place and call 911.
  6. If you stop to help at a motor vehicle accident, be sure you park your vehicle in a safe location, call 911 and watch traffic.

NY tour bus driver was drunk driving prior to fatal pedestrian accident

Timothy White, 29, of Philadelphia, was killed in a New York pedestrian accident when he was hit by a New York tour bus and dragged nearly 30 feet reports the New York Daily News. White was visiting New York with a cousin when the pedestrian accident occurred. He died of massive injuries.

According to the report, the tour bus driver, Steve Drappel, 57, of West Palm Beach, Fla, was driving under the influence of alcohol prior to the fatal pedestrian accident. Police measured Drappel's BAC at 0.08% which is twice the legal limit for commercial drivers. Reports said that Drappel was drinking vodka before the fatal accident.

Drappel faces charges of vehicular manslaughter and Driving While Intoxicated (DWI). Drappel was driving a bus belonging to TraveLynx.

Drappel faces serious personal criminal charges and faces revocation of his driver's license. In addition the family of the deceased may file a wrongful death against both Drappel and the bus company that he worked for. Wrongful death is the death of a person caused by the negligent or wrongful act of another.

Pedestrian injured, dog killed in Gresham, OR drunk driving accident

A suspected drunk driver, Craig Brian Day II, lost control of his SUV and caused a Gresham pedestrian accident in which a pedestrian was seriously injured and the man's dog was killed.

Seattle's KOMO News carried the story and reported that Joshua Grant was hit by the SUV while walking his Labrador Retriever for a walk. Grant was taken to OHSU where he was listed in "fair" condition with a broken leg.

According to the report, Day's SUV rolled a couple of times after hitting Grant before running into a storage unit next to an apartment building. Luckily no one inside of the apartment building was injured.

Day faces charges of driving under the influence of intoxicants, reckless driving, assault, criminal mischief and animal abuse.

Man killed in Marysville-area pedestrian accident

The Herald Net.com reports that a pedestrian, a man in his 40s, was killed in a Marysville-area pedestrian accident on Highway 529.

According to the report, the pedestrian accident occurred around 8:4pm on Saturday night.

The Washington Patrol is investigating the cause of this pedestrian accident. Two of the leading causes of of motor vehicle deaths are driving under the influence and pedestrian violations.

Bellevue police arrest suspect in Crossroads hit-and-run pedestrian accident

Police have arrested a suspect in the Bellevue hit-and-run pedestrian accident that killed a 77-year-old Bellevue woman on Friday night outside of the Crossroads Mall near NE 8th Street and 156th St.

Witness of the Bellevue fatal pedestrian accident were able to provide police with a partial license plate number and a description of the vehicle.

KOMO News aired a story on the hit-and-run accident and a viewer called police and provided a tip about the driver. Police found the suspect vehicle and arrested a 45-year-old man. He was booked into King County Jail on suspicion of hit and run.

Washington state vehicle code RCW 46.52.020, prescribes that a driver that involved in a fatal car accident must stop at the accident scene and remain there until law enforcement has been contacted. Failure to do so can result in a class B or class C felony. A class B felony can result in a maximum sentence of 10 years in prison and $20,000 fine; A class C felony can result in a maximum penalty of 5 years in prison and $10,000 fine.

Woman critically injured in Seattle pedestrian accident

The Seattle Times reports that a woman suffered life-threatening injuries in a Seattle pedestrian accident when she was hit by a pickup truck driven by woman who is now being investigated for driving under the influence.

The woman was walking in the Capitol Hill area of Seattle when she was hit at Boylston Avenue East and East Pine Street at 2:13am.

The injured woman was transported to Harborview Medical Center in Seattle, according to the report.

The driver of the pickup left the scene but police located her and the truck a short time later and arrested her for investigation of drunken driving and leaving the scene of an accident.

The pickup truck driver faces serious charges in this accident including RCW 46.61.522 Vehicular Assault and RCW 46.52.020 Leaving the Scene of an Accident/Hit and Run.

Washington train accidents claim two lives in Western Washington

There were two fatal train accidents today in Western Washington today, the first train accident fatalities of the new year. In 2010, there were 19 train-pedestrian fatalities in Washington state with most occurring between Tacoma and Bellingham.

A Marysville man was hit and killed by a BNSF freight train around 12:10am this morning near Marysville. The Seattle Times report said the man was walking on the tracks when he was struck by a train traveling under 40 mph.

Only 30 minutes after the first fatal train accident, a man was killed near the Sumner Meadows Golf Course while he was walking on the track. The train in that accident was traveling at about 35mph said the report. Sumner is located east of Tacoma near Puyallup and Bonney Lake.

In both pedestrian accidents, the men were on the tracks at points where there was not a crossing. Pedestrian accidents on train tracks are devastating to the railroad workers and to the families of the deceased.

Let's be safe folks: pedestrians should never walk on the tracks and only cross them at designated pedestrian or roadway crossings, observing all warning signs and signals.

Daylight savings time brings increased pedestrian accident risks

We turned back the clocks last week and motorists and pedestrians need to be more aware to prevent pedestrian accidents.

In 2009, 4,092 pedestrians were killed in accidents and 59,000 were injured across the U.S. In Washington state, 61 pedestrians were killed in motor vehicle accidents last year.

According to the NHTSA, 25% of those killed in pedestrian accidents were killed between 4pm and 8pm and 13 percent were killed between 4am and 8am. With daylight savings time and winter upon us, pedestrians and motorists alike must be cautious to avoid an accident.

Motorist Tips

  • Drive slowly especially early morning and evenings when kids are catching buses and walking to and from school.
  • Remember that pedestrians may not hear your approach especially with the ubiquitous use of earbuds and iPods.
  • Use your defroster and make sure your windows are clear.

Pedestrian Tips

  • Choose clothing and backpacks that have reflective tape or materials on them.
  • Don't count on a traffic signal keeping you save: look, listen and make eye contact with motorists before crossing a street.
  • Don't walk or jog in the street; use sidewalks.
  • Use crosswalks to cross the street. Don't cross between parked vehicles.
  • Walk facing traffic.

Police investigating Snohomish County fatal pedestrian accident

Police are investigating the fatal pedestrian accident near Lake Goodwin in which an unidentified man between the age of 18 and 25 was killed.

According to , the Stanwood pedestrian accident occurred shortly before 3:30am on 156th Street Northwest near Lakeview Avenue. Upon arriving at home, an unidentified 20-year-old woman reported to her parents that she thought she hit an animal. Her parents went back to the accident scene and found the body of a man and called 911.

Police say they do not believe alcohol or speed was a factor in the pedestrian accident.

Washington state law calls for any motorist involved in an accident in which a person is injured or killed or in which there is property damage to stop and render emergency aid or exchange information. Every hit and run accident case is unique and charges depend on what happened in the accident. Felony hit and run charges may be made pursuant to vehicle code RCW Chapter 46.52 if a person is killed in an accident and the driver left the scene.

Man killed in Sumner Amtrak train accident

Kirotv.com of Seattle reports that a man was killed when he was hit by an Amtrak train in Sumner, Washington.

According to the report, the Sumner train accident occurred Zehnder Street at 6pm in downtown Sumner.

The unidentified train accident victim is described as a 40-year-old man.

Sumner is located east of Tacoma near Puyallup and Bonney Lake.

There have been 16 people killed on BNSF train tracks in Washington so far this year.

Pedestrian accidents
on train tracks are devastating to the railroad workers and to the families of the deceased.

This type of pedestrian accident can occur when a person only thinks about one train crossing at a time. Accidents like this occur when the first train has passed and a second train comes by on a parallel track.

A week ago, a 17-year-old Minday Doster was killed while walking near a BNSF Railway line. In that train accident, Doster was not on the track but she was struck by an overhanging part. Trains can overhang their tracks by at least three feet and items like hooks and other components can hang off the sides and hit a person.

To be safe, people should not walk near train tracks and only cross them at designated pedestrian or roadway crossings, observing all warning signs and signals.

Woman killed in Edmonds pedestrian accident

The Seattle Times reports that a Seattle woman, 39, was hit and killed in a Edmonds pedestrian accident on Aurora Avenue in Edmonds around 1:30am this morning.

According to the report, the pedestrian accident occurred in the 21400 block of Aurora.

The driver of the car called 911 and stayed at the accident scene. Police are investigating the cause of the pedestrian accident but they did not make any arrests.

The focus of the investigation will probably focus on whether the driver or the victim were under the influence of alcohol at the time. They will also determine whether the motorist was speeding, whether the victim was in a crosswalk and was wearing clothes that made her visible.

Woman charged with 'Vehicular Homicide in Seattle hit-and-run accident that killed tow truck driver

The Seattle Times reports that Shavelle Lewis has been charged with Vehicular Homicide and hit-and-run driving in the death of tow-truck driver William Padilla, 51.

According to the report, Lewis, was driving with a suspended license, when she crossed several lanes of traffic and struck Padilla who was kneeling on the ground preparing to tow a disabled vehicle at the Spokane Street entrance to Interstate 5 in Seattle.

Lewis drove off after the Seattle car accident but she was apprehended a short time later.

The result of Lewis' blood alcohol content (BAC) test is not back yet but Washington State Troopers said she appeared intoxicated.

Lewis has prior convictions for prostitution, drug crimes and hit-and-run driving. She had 14 prior arrest warrants.

Washington State Vehicle Code, RCW 46.61.520, states that a person can be charged with Vehicular Homicide if a person was killed in a motor vehicle accident and the driver was driving under the influence of alcohol or drugs.

Man hit and killed by Sounder train in Puyallup

The Seattle Times reports that a man who was in his 20s was hit and killed by the Sounder train south of Puyallup on Tuesday morning.

The report said the man's body was found on the tracks around 7:30am and that it was possible that no one on board the train were aware of the pedestrian accident.

The Sounder was traveling from Seattle to Tacoma and the pedestrian accident occurred near 18th Street Northwest and West Stewart Avenue.

Thirteen pedestrian have been killed in train accidents this year in Washington state.

State of Washington agrees to $4.25 million settlement to Burien woman injured in pedestrian accident

Kathie Larson, 52, reached a $4.25 million dollar in a settlement with the Washington State Department of Corrections (DOC) after a felon ran her down with her car and critically injured her while she was crossing a Tacoma street in June of 2008.

Larson's negligence lawsuit against the state claimed that the DOC should have supervised
Aiyisha Gillespie, 30, the woman who hit Larson with her car, more closely because they knew she was mentally ill. Gillespie was being supervised after a conviction for a similar offense.

Larson's injuries were so severed that she was confined to a hospital for six months and she has not fully recovered a little more than two years after her pedestrian accident.

Larson's daughter said that one purpose for her mother's lawsuit was to force the DOC to more closely supervise mentally ill felons.

Man seriously injured in Spokane hit-and-run pedestrian accident

The Spokesman-Review reports that a man was seriously injured in a hit-and-run pedestrian accident around 3am on Thursday. The man may have suffered a broken pelvis.

According to the report, the man was walking in a crosswalk at Riverfront Park in Spokane when he was hit by a car that then left the scene. The injured man identified the vehicle as a gray 1990s Cadillac.

The injured man was helped to the sidewalk by a witness who then left him.
