Seattle Police arrest two drivers for Vehicular Assault over weekend

The Seattle Police Department was kept busy this weekend with two separate accidents caused by drivers who were suspected of driving under the influence (DUI) and subsequently arrested on suspicion of Vehicular Assault. Many of the Seattle Police Department DUI squad have been trained as qualified Drug Recognition Experts (DRE) and can evaluate whether a driver is under the influence. Lab tests conducted by state toxicologist evaluate the submitted blood samples following an impairment evaluation or arrest.

The first motor vehicle accident occurred around 2:00am on Sunday morning in West Seattle when a woman driving a full-sized fan ran a stop sign at SW Cambridge and hit a small car. The force of the collision crushed the driver's side of the passenger car and pushed the vehicle up a sidewalk and onto a fence. Both occupants of the passenger car were critically injured in the accident and were taken to the hospital. The driver of the van, along with her three passengers, were apprehended after they initially fled the accident scene.

The second motor vehicle accident occurred in downtown Seattle around 3:00am when an Infiniti SUV and a Ford F-350 truck collided in the intersection of 4th Avenue at Cherry Street. The two men in the pickup truck suffered minor injuries and were taken to Harborview Medical Center. The adult male driver of the pickup truck and one of his male passenger suffered minor injuries. Another male passenger in the pickup truck suffered serious injuries. The driver of the Infiniti SUV was tested and is suspected of being under the influence of alcohol and or drugs pending lab tests. He was arrested for investigation of Vehicular Assault.

Vehicular Assault

Vehicular Assault, RCW 46.561.522, can be charged if a person seriously injures another person in a motor vehicle accident while driving recklessly, driving under the influence of alcohol or drugs or driving without regard to the safety of others. Vehicular Assault is considered a Class B felony and can result in license suspension/revocation, fines, and jail or prison time.

In addition to criminal charges, the injured has a legal right to pursue damages from person whose negligence injured them by claiming against that person's car insurance and also by filing a claim in civil court.
