Boater "not guilty" in Lake Tapps boating accident in which man was killed, 4 injured

Richard Neil Larsen, 43, was found not guilty of the 2008 fatal boating accident which killed Ron Scott, 49, and injured four people in Scott's boat reports Seattle's KOMO News.

Larsen had been charged with one count of homicide by watercraft and four counts of watercraft assault as a result on the September 2008 boating accident. His two week trial on these charges ended with the jury acquitting him of any wrong-doing.

Scott had been motoring his Bayliner with friends aboard when his boat was hit by Larsen's 21-foot Supra between Interlake and Inlet Islands. When the Supra hit the Bayliner, it went over the top of the Bayliner and Scott was knocked into the water. Six people on the Bayliner were injured.

Larsen's defense successfully argued that Scott was at fault in the boating accident because he parked his Bayliner in a narrow channel and did not have any lights on.

The U.S. Coast Guard keeps boating accident statistics and, according to their numbers, there are between 7.5 to 9.9 deaths per 100,000 registered boats in Washington state every year. In both 2008 and 2009, there were 22 fatalities in boating accidents in Washington state which was down from a high of 26 in 2007.

Brain injured Edmonds man receives $10 million personal injury settlement in case against King County

King County has agreed to pay the family of Christopher Sean Harris $10 million dollars after Harris suffered a traumatic brain injury when he was slammed against a concrete wall by King County deputies.

Harris' brain injury is so severe that he is paralyzed, unable to speak, is bed-ridden and requires constant care.

Harris, who is from Edmonds, was critically injured in May 2009 in Seattle. His family filed a personal injury lawsuit against King County claiming that unnecessary force was used against Harris when deputies arrested him. Harris was in Seattle and ran when police chased him thinking that he had been involved in an altercation at a bar. It turned out that a witness had misidentified Harris.

It's unclear whether Harris knew it was police officers chasing him. Deputies were in black tactical uniforms instead of traditional deputy uniforms.

A trial of the lawsuit against King County had gone to trial but attorneys in the case settled before the trial was concluded. According to The Seattle Times, some of the jurors polled believed that excessive force was used against Harris and that Harris may not have known that it was law enforcement that was chasing him.

DePuy hip implant recall shows the need for National Joint Registry in the U.S.

DePuy Orthopedics issued a recall of the ASR XL Acetabular and Hip Resurfacing Systems due to a high revision rate in August 2010. This was up to several years after sales of the device had been halted in countries such as Australia. Evidence had been mounting since 2007 that the DePuy hip implants were defective after patients complained of severe pain and other problems within five years of their hip replacement.

In 2007, the National Joint Replacement Registry in Australia started noticing higher than average failure rates -- 12 to 13% -- for the ASR implants compared to devices manufactured by other companies. Data came in from other countries' registries as well: in the UK, they noticed a 12 or 13% failure rate; in Sweden, the data said there was a 8.8% revision rate over a 3 year period. The failure rates gleaned from these registries showed that the DePuy products had a four times greater revision rate within 5 years and resulted in the DePuy hip systems to be pulled from these foreign markets. Some registries think that the failure rates are underestimated by 10%

In the United States, however, the defective DePuy ASR hip implants were not recalled until much later even though the Food and Drug Administration had received nearly 400 complaints. One wonders, "Why not?" One factor in this is that the United States does not have a "National" joint registry system.

We might only look to Australia as a model for a National Joint Replacement Registry. The Australian Orthopaedic Association founded their registry in 1999 to track data having to do with surgical outcomes based on a patient's age, diagnosis, prosthesis type and surgical technique, etc. In measuring outcomes of a surgery, the principal measure is the revision rate, or the need for a "redo" surgery.

CPSC issues stroller recall after reports of finger injuries

The US Consumer Product Safety Commission has announced that Phil & Teds USA Inc. has issued a voluntary recall of the sport v2 and classic v1 jogging strollers because the product poses a finger amputation risk.

The CPSC says in their media release that there has been three reports of injuries due to the stroller including a finger tip amputation.

According to the release, the strollers were manufactured in China and sold throughout the U.S. between May 2008 and July 2010.

East Wenatchee car accident kills passenger, driver arrested

Seattle's KOMO news reports that Joseph A. De Grasse, 29, has been arrested for investigation of DUI and Vehicular Homicide in the East Wenatchee car accident that killed his passenger, Jacob D. De Los Reyes, 28.

According to the report, the car accident occurred around 6PM on Highway 28 just east of East Wenatchee.

De Grasse was allegedly driving drunk when he hit a bus parked at the side of the road.

De Grasse was taken to Central Washington Hospital for treatment of a head injury and then booked into the Chelan County jail.

We see this kind of motor vehicle accident far too often. When people drive drunk, they often mistake a vehicle parked on the side of the road as moving and slam into it. These are some of the worst accidents because striking an object that is not moving when a car is traveling at speeds higher than 25 miles per hour are often fatal.

Washington Vehicle code RCW 46.61.520, Vehicular Homicide, can be charged if a person is killed in a car accident and the driver was driving under the influence of alcohol or drugs. When a driver is charged with Vehicular Homicide, he or she is tried by the State of Washington. In addition, the family of a person killed as a result of Vehicular Homicide can bring a suit for wrongful death.

Woman critically injured in Seattle pedestrian accident

The Seattle Times reports that a woman suffered life-threatening injuries in a Seattle pedestrian accident when she was hit by a pickup truck driven by woman who is now being investigated for driving under the influence.

The woman was walking in the Capitol Hill area of Seattle when she was hit at Boylston Avenue East and East Pine Street at 2:13am.

The injured woman was transported to Harborview Medical Center in Seattle, according to the report.

The driver of the pickup left the scene but police located her and the truck a short time later and arrested her for investigation of drunken driving and leaving the scene of an accident.

The pickup truck driver faces serious charges in this accident including RCW 46.61.522 Vehicular Assault and RCW 46.52.020 Leaving the Scene of an Accident/Hit and Run.

Surgeons blame design flaw caused high failure rate in DePuy Hip implants

DePuy Orthopaedics recalled the ASR XL Acetabular Systems total hip replacement and the ASR Hip Resurfacing System in 2010 after studies showed that 12to 13 percent of patients had a failure rate which required another replacement in only five years after their hip replacement. This amount accounts for 12 to 13% of the total number of hip transplant patients.

DrugWatch reports that physicians and orthopedic surgeons believe that the faulty design of the DePuy hip implant is the cause of the high failure rate. Surgeons point to the design of the hip cup specifically saying that it was designed too shallow which which results in edge-loading where the hip implant ball rubs against the cup's edge, causing metal debris to be rubbed off, releasing metal ions of cobalt and chromium, causing a condition called metallosis.

Hip implant registries in Australia and Great Britain alerted Depuy in 2008 of high failure rates when compared with other company's hip implant devices yet DePuy continued marketing the implant in the U.S.

Dentist investigated in death of 13-year-old girl

Doctor Henry Mazorow, a Ohio dentist, is being investigated in the death of 13-year-old Marissa Kingery, who became unresponsive during dental surgery to remove several teeth and died after being taken off of life support about two weeks later.

According to a report on Fox 8 Cleveland, Marissa was undergoing the extraction at the dentist's office under anesthesia. The Coroner's Office says it appears as if Marissa Kingery died at the result of a lack of oxygen to the brain.

Dr. Mazorow, who is 81 years old, has never had complaints lodged against him.

Death of a child during dental procedures is fairly rare. In Washington state, between 2005 and 20007 there were approximately seven deaths of patients during dental procedures. Back in 2008, Dr. Fred Quarnstrom, a Seattle Dentist and a University of Washington dental instructor expressed concerns to Gov. Gregoire that dental deaths were not being investigated thoroughly and that one dentist received a anesthesia permit though he had not completed a one year general anesthesia residency.

Anesthesia medical errors are often a result of inadequate monitoring of the patient or improper administration of anesthesia medications. These are two of the most frequent areas of medical malpractice.

Army doctor pleads guilty for taking kickbacks from medical devices co.

Major Jason Layne Davis, 38, a cardiologist at Madigan Army Medical Center, pleaded guilty to accepting about $4,800 in cash, meals and other gratuities from Guidant Sales Corp, a former subsidiary of Boston Scientific.

Major Davis was the chief of Madigan's cardiology department and ordered Boston Scientifics' pacemakers and implantable defibrillators for his patients and encouraged his colleagues to do the same. Apparently Maj. Davis accepted the gifts in exchange for exclusively using Boston Scientifics' products.

Major Davis crossed the line because army doctors are government employees and are bound to ethical guidelines for federal employees:

Employees shall not solicit or accept any gift or other item of monetary value from any person or entity seeking official action from, doing business with, or conducting activities regulated by an employee’s agency, or whose interests may be substantially affected by the performance or nonperformance of the employee's duties.

The charge against Maj. Davis is a misdemeanor and subject to a year in prison and a $100,000 fine. Guidant Sales paid $600,000 to settle claims.

Washington train accidents claim two lives in Western Washington

There were two fatal train accidents today in Western Washington today, the first train accident fatalities of the new year. In 2010, there were 19 train-pedestrian fatalities in Washington state with most occurring between Tacoma and Bellingham.

A Marysville man was hit and killed by a BNSF freight train around 12:10am this morning near Marysville. The Seattle Times report said the man was walking on the tracks when he was struck by a train traveling under 40 mph.

Only 30 minutes after the first fatal train accident, a man was killed near the Sumner Meadows Golf Course while he was walking on the track. The train in that accident was traveling at about 35mph said the report. Sumner is located east of Tacoma near Puyallup and Bonney Lake.

In both pedestrian accidents, the men were on the tracks at points where there was not a crossing. Pedestrian accidents on train tracks are devastating to the railroad workers and to the families of the deceased.

Let's be safe folks: pedestrians should never walk on the tracks and only cross them at designated pedestrian or roadway crossings, observing all warning signs and signals.

Women risk higher DePuy hip replacement redos then men

Women with DePuy hip implants may require revision surgery at a higher rate then men according to data from the National Joint Registry of England and Wales.

In August 2010, DePuy Orthopedics recalled the ASR Hip Resurfaacing System and ASR XL Acetabular System total hip replacement after the devices were linked to higher failure rates than other hip replacement products.

The University of Adelaide in Australia found that the a patient's hip size is one factor in higher failure rates in some patients. Patients that were implanted with ASR femoral head sizes below 50mm in diameter were at a greater risk for a second surgery. This affects mostly smaller and female patients.

Since DePuy first marketed the ASR hip implant systems, there has been a 12-13% failure rate of the hip within five years of the initial surgery. Approximately 93,000 people have received the implants.

Joint replacement agencies in both Australia and in the United Kingdom discovered that patients were having higher than expected complications including loosening of the implant with the body, bone fractures near the implant, dislocation and a condition called metallosis which is a condition when there is metal-on-metal rubbing of the implant. The United States does not have a Joint Registry.

FDA places limits on acetaminophen in Vicodin & Percocet, among other drugs

The FDA announced today that they are asking manufacturers of medications containing acetaminophen to limit the amount of acetaminophen to 325 mg per tablet. The FDA takes this move because overdoses of acetaminophen cause liver damage which results in the need for a transplant, or results in death. In fact 40% cases of acute liver failure were caused by overdoes of acetaminophen.

In addition to limiting the amount of acetaminophen used in a drug, the FDA is also requiring manufacturers to update their drug labels to highlight the potential risk of severe liver failure if more than the recommended dosage is taken Many patients are not aware that if they use certain prescriptions in combination with other medications which include acetaminophen or used in combination with alcohol that they risk the result of liver failure. A FDA group report said:

“There is extensive evidence that hepatotoxicity (liver toxicity) caused by acetaminophen use may result from lack of consumer awareness that acetaminophen can cause severe liver injury.”
Acetaminophen is mixed in combination with other agents and us used to treat pain, fever and cough. It is often combined with opiates such as Vicodin and Percocet. Vicodin and generic version of the drug are the most commonly prescribed medicine in the United States with pharmacists dispensing more than 128 million prescriptions in 2009 alone.

Kennewick man seriously burned after fueling pickup truck

The Seattle Times reports that a Kennewick, Washington man suffered serious burn injuries after he put fuel in his pickup truck.

According to the report, the man filled up his truck, drove from the gas station but accidentally caught his clothes on fire when he lit a cigarette and gasoline on his clothing caught on fire.

The man jumped from his moving pickup truck and the truck crashed into a flagpole.

In total hip replacement patients it can be caused when there is metal-on-metal rubbing of the artificial hip joint which releases metal ions such as cobalt and chromium. These wear particles trigger an immune response which causes resorption of living bone tissues.

Often osteoloysis is asymptomatic -- without symptoms -- and can lead to the hip implant loosening or a bone breaking.

Five hip replacement patients from Chicago who received a DePuy Orthopedics ASR hip implant have filed product liability lawsuits against DePuy Orthopedics accusing DePuy of failing to recall the medical device even though there was mounting evidence that the hip implant device was defective reports ABC 7 News.

Four accuse Vancouver pain clinic of medical malpractice for overprescribing opiates

The Seattle Times reports that four plaintiffs have filed medical malpractice and wrongful death lawsuits against three nurse practitioners at the Vancouver,Washington Payette Clinic alleging that they or their loved ones were harmed because of nurse practitioners at the clinic over-prescribed narcotics.

In the lawsuit, the plaintiffs claim that excessive amounts of controlled substances were prescribed which caused multiple overdose deaths and caused others to become physically addicted.

The lawsuit claims:

Payette Clinic practitioners continued prescribing large quantities of controlled substances even after they were aware of at least six deaths of patients from their clinic and after numerous doctors, nurses, pharmacists, and family members of patients had complained about the excessive quantity of drugs being prescribed by Payette Clinic.

The estates of Deborah E. Reid and Karen Stransky, who both died of opiate overdoses have filed wrongful death lawsuits.

Tina Wright and Malvena Goetz both claim that they were prescribed "grossly excessive" amounts of opiates which caused them with physical and mental injuries.

The Washington State Department of Health and the U.S. Drug Enforcement Administration investigated the clinic and ordered Kathy Bell, Penny Steers and Scott Pecora, nurse practitioners, to forfeit their licenses to prescribe narcotics for two years beginning in January 2010.

The DOH is still investigating 14 cases against Steers.

Woman critically injured in I-90 car accident when semi truck hits her car head-on

The Spokesman Review reports that Kate E. Cummings, 27, of Missoula, MT, was critically injured in an Interstate 90 motor vehicle accident when her Subaru was hit head-on by a semi truck.

The motor vehicle accident occurred approximately 48 miles east of Coeur D'Alene, Idaho, around 10:30am on Thursday when Yuriy V. Kushniruk, 30, of Vancouver, Washington, lost control of his semi, went over the barrier and hit Cummings' Subaru head-on.

Cummings was traveling with two children in her vehicle and their ages and condition was not reported.

It is unclear if Kushniruk will be cited in the truck accident but the report quoted police as saying he was driving too fast for the slushy road conditions.

Nearly half of DePuy ASR hip implant patients in Ireland may need 2nd surgery

RTÉ News of Ireland reports that nearly 1,700 of the 3,500 people who received a DePuy ASR hip implant subject to the International recall will require surgery to replace the defective DePuy ASR hip implant.

A medical engineering expert at Newcastle University, Dr. Thomas Joyce, said that the danger of the DePuy ASR hip implant is not only mechanical failure but metal poisoning.

Metal poisoning from the device is caused when the ball and the socket of the hip implant rub -- a metal-on-metal contact -- which creates a fine metal dust containing cobalt and chromium ions which can cause inflammation in the hip joint and surrounding tissue and can also can lead to other health problems including kidney damage and heart problems.

DePuy Orthopaedics, a division of Johnson & Johnson, issued a world-wide recall of the product in August of 2010. DePuy said that they thought that only 12% of the 3,500 Irish implant patients would require a revision, or second surgery.

Hansville man dies after fall in Bremerton tree trimming accident

The North Kitsap Herald reports that Aaron Bjorn Waag, 28, of Hansville, died after falling at least 70 feet from a boom crane hook as he worked cutting branches from several tall fir trees.

According the report, Waag was working at a property off Rocky Point Road NW in Bremerton when the 10:30am accident occurred.

First responder administered CPR and Waag was taken to Harrison Medical Center in Bremerton where he was pronounced dead.

The cause of the accident is under investigation by the Department of Labor and Industries bit it appears that that Waag's climbing harness became detached from the boom hook.

Waag worked in his family's business, Waag Tree Service.

Seattle City Light discovers more electrified light poles

Seattle City Light started inspecting light poles throughout the city after a Sammy the dog was killed in a Seattle electrocution accident. The Seattle Times reports that since the inspections began, Seattle City Light has found 21 hazardous streetlights that had the potential to shock or electrocute a person or a pet.

It appears that the cause of the electrical problems has several causes including Improper installation of equipment; Poor installation instructions; Deterioration of aging equipment; and Improper testing and maintenance of equipment.

Mark Voigtsberger of Power Quality Testing published a report "ANALYSIS OF PUBLIC SHOCK AND ELECTROCUTION CASES" after collecting and analyzing data of accidental public shock and electrocution accidents. Voigtsberger gathered his data searching through newspaper database between 1980 and the present. He found 54 electrocutions and 18 shocks due to contact with with public energized surfaces.

Rollover car accident on Orcas Island injures Islands' Sounder Publisher and husband

Elyse Van den Bosch, the publisher of the Island's Sounder, The Journal of the San Juan Islands and The Islands' Weekly, and her husband, Fred Munder, were injured in an Orcas Island rollover car accident when the SUV they were riding in was clipped by an 18-wheeler as they were headed towards the ferry landing.

Colleen Armstrong, writing for the Islands' Sounder, reported the car accident occurred around 6:30am on Orcas Road as the pair was headed south near Cove Road. A trailer attached to a semi-truck crossed the line and hit the couple's SUV. The couple's SUV then rolled and landed upside down.

Munder suffered both a broken leg and arm and Van den Bosch suffered a fractured hip in the motor vehicle accident. The couple were both airlifted to St. Joseph Hospital in Bellingham where Van den Bosch was transported to Harborview Medical Center in Seattle for surgery.

The truck driver was cited in the motor vehicle accident.

House Bill 1018 adds responsibilities to both drivers and bicyclists

Washington House Bill 1018 which is sponsored by Representative Jamie Pederson, D-Seattle, seeks to add new sections to the Washington State Vehicle Code RCW 46.61 and to recodify two existing sections: RCW 46.61.755 and 46.61.770.

The proposed new section is an attempt to reduce car and bicycle accidents. The section clarifies responsibilities of both bicyclists and motorists.

Section 46.61.755 would be amended to include the following:

  • Bicyclists shall have same rights and duties as a motorist on a roadway.
  • Bicyclists on sidewalks, crosswalks or multi-use trail shall yield the right-of-way to the pedestrian, however, the pedestrian should exercise due care.
Section 46.61.770 would be amended with language that tells motorists to give bicyclists more room and drive at a safe distance away from bicyclists and pedestrians and not to honk at them. Language was also added that tells bicyclists that when they are traveling at speeds slower than motorists, they should right in the designated bicycle lane or as close to the curb as is safe.

In 2009, there were 630 bicyclists killed in accidents with motor vehicles. This was the lowest number of fatal bicycle accidents since 1975. The wider use of helmets is one reason for the reduction in deaths; helmet use reduces the risk of a head injury by 85%. 36% of bicycle deaths occurred in intersections according to data collected by the Federal Accident Reporting System.

Puyallup man charged with Vehicular Assault in head-on car accident

The Washington State Patrol reports that Benjamin Cabral, 36, is being charged with Vehicular Assault in the State Route 512 wrong-way car accident that injured Miguel Salinas of Lakewood.

The report said that Cabral drove his car for the wrong way for more than 3 miles when he collided with Salinas near Steele Street.

Cabral and Salinas were both seriously injured in the car accident. A 23-year-old female passenger in Salinas' car suffered only minor injuries.

Police suspect Cabral was under the influence of alcohol at the time of the car accident. Washington State vehicle RCW 46.61.522 states that a driver can be charged with Vehicular Assault if he or she seriously injures someone while driving recklessly, driving under the influence of alcohol or drugs or driving without regard for the safety of others.

Sprouters Northwest of Kent recalls clover because of salmonella link

Sprouters Northwest, a local grower of fresh sprouts located in Kent, Washington, has issued a recall of several of their sprouts products after the Oregon Health department found a possible link to people who became ill due to salmonella and the Sprouter's Northwest's products.

According to a report by Seattle's King 5 news, two people were sickened in Oregon and four people in Washington due to the salmonella bacteria. The illnesses occurred between December 4 and December 17.

Salmonella is a foodborne illness which can be caused by consuming contaminated food. One form of the bacteria is Salmonella Enteritidis which is linked to chicken eggs; it causes approximately 142,000 reported cases of illness every year resulting in approximately 30 deaths.

Symptoms of foodborne illness can include dehydration, diarrhea, fatigue, fever, headache, nausea and vomiting.

Recalled Products

The recall includes the following products, all with a "best by" date of 1/16/11 and earlier:
  • 4 oz. (UPC 8 15098 00201 6) and 5 oz. (UPC 0 33383 70235 3) containers of Clover sprouts.
  • 1-lb. bags of Clover (UPC 0 79566 12351 5), and 2-lb. trays of Clover (UPC 0 79566 12362 1).
  • Clover Onion sprouts in 4 oz. (UPC 0 79566 12361 4) and 5 oz. (UPC 0 79566 12361 4) containers.
  • Deli sprouts in 4 oz. (UPC 8 79566 12305 4) and 5 oz. (UPC 0 33383 70267 4) containers.
  • Spicy sprouts in 4 oz. (UPC 8 15098 00202 3) containers.
