Woman hit and killed by Amtrak train in Puyallup

The Seattle Times reports that a 36-year-old Pierce County resident was hit and killed by an Amtrak Train around 2 am this morning.

According to the report, the woman had been missing and was described as suicidal. The report said that the incident did not occur at a railroad crossing and that there were no passengers on the train at the time.

The train was en route to Seattle from Portland at the time of the incident.

2 killed, 5 injured in car accident involving Vancouver, WA family

A Vancouver, Washington family was involved in a car accident when their Suburban rolled over on Interstate 80 in Wyoming as they were returning home from Maryland after celebrating the holidays with relatives.

According to a report in The Seattle Times, the driver of the SUV was killed along with a 9-year-old child. Two adults and three children survived the accident

All seven people in the Suburban were ejected from the vehicle in the car accident; no one was wearing a seatbelt. The Highway Patrol believes that inattentive driving or the driver falling asleep was the cause of the accident.

Court of Appeals rules against City of Seattle in pedestrian accident case

The Puget Sound Business Journal reports that the Washington State Court of Appeals has ruled in favor of Xiao Ping Chen, who filed a wrongful death lawsuit against the city of Seattle after her husband, Run Sen Liu, was critically injured in a pedestrian accident and then subsequently died.

Liu was hit by a motor vehicle as he crossed the intersection at South Jackson Street and 10th Avenue in South in Seattle, February of 2007. He suffered a traumatic brain injury and was in a coma for two years before he died.

In her lawsuit, Chen alleged that Seattle was negligent in maintain the roadway. Evidence showed that there had been previous serious accidents at the same pedestrian crosswalk where Liu was injured.

In reversing a lower court ruling against Chen, the Court of Appeals said, "a municipality has a duty to all travelers to maintain its roadways in conditions that are safe for ordinary travel."

Washington State has a wrongful death statute which allows the family of a person who was killed due to the negligence of a person or entity to recover damages in a civil action. Wrongful death cases are usually brought on behalf of the deceased by the surviving spouse, child or parent.

Spokane man sues Idaho for negligence because of potholes

Kasey Crick, 22, of Spokane has filed a lawsuit against the state of Idaho alleging that Idaho's negligence in repairing potholes caused a motor vehicle accident on Interstate 90 which left him with serious injuries.

Crick filed the lawsuit after Idaho did not respond to a tort claim he filed in 2007. In his negligence lawsuit, Crick asks for $500,000 in compensation for medical bills, lost wages, and for tuition for missed school.

According to an Associated Press article that appeared in the Seattle Post-Intelligencer, Crick suffered a broken pelvis and other injuries after a series of mishaps caused by potholes in the road.

The maintenance coordinator for the Idaho Transportation department had received complaints about the potholes but that weather prevented resurfacing the road.

Federal Way begins issuing tickets for speed cameras in school zones

Federal Way begins issuing tickets for drivers who speed in school zones and are caught by speed cameras at Twin Lakes Elementary School located on Southwest 320th Street and Saghalie Middle School located on 21st Avenue Southwest beginning on Tuesday reports the Tacoma News Tribune.

The speed cameras, which were activated about a month ago, have caught about 676 drivers speeding in the school zones so far. Tickets for speeding will cost violators between $189 and $250 based upon how fast they were going.

In June, a class action lawsuit was filed in King County Superior Court alleging that 19 Washington cities overcharge drivers who receive red light camera tickets. Motorists claim that the legislation which allows cities to install the cameras was supposed to be for safety and not to primarily raise money for the cities. Ice-related car accident in Oregon kills 1 and injures 3 Prosser, WA residents

A car driven by Ronald Eugene Beck, age 58, of Prosser, Washington was involved in a four-car accident on Highway 42 in Oregon in which one of his passengers, a 74-year-old Oregon woman, was killed and two of his passengers were seriously injured.

According to a report by the Oregon State Police, Beck's vehicle, a PT Cruiser, was hit nearly head-on by a Dodge pickup truck that had lost control due to icy conditions. Beck's rear seat passenger Sigrid Wilma Wheeler, of Coos Bay, was killed. Beck's other two passengers, Sarah Helen Beck, age 54, and Amber Nicole Olson, age 22, both of Prosser were seriously injured in the car accident. Ronald Beck received minor injuries in the accident. Prosser is a city West of the Tri-Cities area of Pasco, Richland and Kennewick.

The Oregon State Patrol is investigating the motor vehicle accident and are trying to determine if Wheeler was wearing a safety belt.

Idaho man files medical malpractice suit saying surgeons left device in knee

Kennewick man suffers injuries in motorcycle accident

The Tri City Herald.com reports that Phillip LoParco, age 64 of Kennewick, suffered serious injuries including a fractured vertebrae when he was injured in a motorcycle accident around 11:15am this morning in Kennewick.

According to the report, LoParco was turning left onto Washington Street from Columbia Drive on his motorcycle when he was hit by a Dodge Caravan driven by Nova Lawton.

Preliminary investigation finds that LoPorco failed to yield when he made the left hand turn.

Burnt Ridge Orchards recalls hazelnuts due to possible salmonella contamination

Burnt Ridge Orchards located in Onalaska, Washington, is recalling just under 100 pounds of shelled hazelnuts sold between Nov. 17 and Dec. 14 at the Olympia Farmers Market for fear of salmonella contamination reports The Olympian.

The recall comes after routine testing made by the Food and Drug Administration at the shelling company. The unnamed processing company has halted the nut processing until the FDA finds the source of the contamination.

Hit-and-run driver kills Arlington man in Marysville, driver charged with vehicular homicide

A pedestrian was hit and killed by an alleged drunk driver who then left the accident scene in Marysville reports The Everett Herald Net.

According to the report, the pedestrian was a 26-year-old Arlington man. He was walking in the 10400 block of Smokey Point Boulevard around 2 am when he was hit. Bystanders provided CPR but the man could not be revived.

Later, the Washington State Patrol stopped a speeding driver who asked the trooper what he had hit. The driver's Blood Alcohol Content was measured at .177, more than two times the legal limit of 0.08%. He is being investigated for Vehicular Homicide which can be charged if a driver was driving under the influence and a person in killed.

Snohomish-area car accident on State Route 2 injures 2

Two people were injured in a car accident when one car crossed the center line and crashed into another vehicle at 88th Street on State Route 2.

Seattle's KOMO News.com reports that one person had life threatening injuries and the other had serious injures after the car accident.

Residents have been clamoring for either a four-lane highway or barriers calling State Route 2 unsafe. State Route 2 near Snohomish is a mountain highway and can be heavily used. License revoked from Olympia adult family home

The Department of Social and Health Services has revoked the license of Lakeside Gardens AFH LLC, an adult family home in Olympia. The DSHS has also prevented any one new being admitted to the home reports The Olympian.

According to the report, the DSHS took these action because they felt that there was negligence which impacted the "safety and well-being" of the people that lived there. The DSHS felt that residents susceptible to repeated falls did not receive adequate care or fall prevention plans to keep it from happening. DSHS also noted that the home did not obtain emergency care for a person who had facial injuries after a fall.

The adult family home, licensed to Jennie Carkhuff, has 28 days to contest the DSHS' actions. Current residents may choose to remain in the home.

Monroe man dies of burn injuries caused by propane heater

A 76-year-old Monroe man whose clothes caught on fire last week after he backed his wheelchair into a propane heater, has died of his injures at Harborview Medical Center in Seattle.

According to a report in The Seattle Times, the man had suffered burn injuries to 40% of his body.

Truck driver from Auburn injured in Highway 167 accident

The Seattle Times reports that a 46-year-old truck driver from Auburn was critically injured when the tanker truck he was driving ran into an Highway 167 overpass. The unidentified man was taken to Harborview Medical Center in Seattle for treatment.

Small boy killed in Rottweiler attack

The Washington Examiner.com reports that a 20-month old Florida boy was attacked and killed by a Rottweiler dog.

According to the report
, the toddler, Dallas Walters, was at his aunt's house when he dropped a cookie. When the boy went to pick up the cookie, the dog bit and attacked him.

Family members pried the dog off of the toddler but he died of his injuries at a hospital.

Children at risk of injury or death when TV sets or furniture tip over

The U.S. Consumer Product Safety Commission warns parents about the dangers of heavy furniture, appliances and -- especially TVs -- tipping and falling on small children and seriously injuring or killing them. In a report entitled Instability and Tipover of Appliances, Furniture and Televisions: Estimated Injuries and Reported Fatalities, 2008 report the CPSC urges parents to secure TVs, furniture and appliances to avoid tip-overs. The CPSC has also prepared a video about furniture tip-overs that you can watch on YouTube.

According to CPSC estimates, in 2006 alone 16,300 children age five and younger were injured due to TVs or furniture falling on them. Between the years 2006 and 2008, they estimate that there were 134 deaths in this same age category. Sammamish woman killed, Seattle man injured in Oregon car accident

Jenna Lee Ulrich, 22, of Sammamish, was killed and Thomas Stroppel, 26, of Seattle was injured in a car accident near Huntington, Oregon on Saturday reports the Sammamish Reporter.

According to the article, Ulrich, who was a senior at University of Washington, lost control of her vehicle on Interstate 84 near milepost 339 and was hit by a commercial truck. Ulrich was killed at the accident scene.

1 man killed, 1 injured in Hwy. 20 car accident near Concrete

Christopher Paul Lilly, age 25, of Concrete, was killed and his passenger, Brice D. Kucera, age 21, also of Concrete, was injured when their vehicle went off the road and hit a utility pole. The single-car accident occurred around 4:35am on Saturday on Highway 20 west of Concrete.

According to a report in The Seattle Times, both men were ejected in the accident as neither was wearing a seat belt.

Police believe that Lilly may have been driving under the influence (DUI) at the time of the motor vehicle accident as Kucera told them that both men had been drinking in Bellingham and were on their way home.

Construction worker killed in Guemes Island accident

A 57-year-old construction worker from Mount Vernon was killed in a construction accident on Guemes Island after a house that was being lowered fell off its foundation and crushed him. Guemes Island is a small island in the San Juan Islands chains just north of Anacortes.

According to an article in the Seattle Post-Intelligencer, five other construction workers were involved in the project but were able to escape injury. The accident occurred around 3:15pm on Saturday afternoon.

Tacoma speed cameras raising millions in revenue

Since Tacoma started fining speeding drivers on December 2, they have issued, or will be issuing, over 2,000 tickets to registered owners of cars caught speeding on Bay Street near the Emerald Queen Casino. At $101 fine per ticket, the city could raise approximately $11 million in revenue reports The Tacoma News Tribune.

A speed camera near Downing Elementary School has not caught any speeders since its installation. The school zone camera is activated 30 minutes before school begins and 30 minutes after it ends. The city has also installed signage which, along with the camera, seems to be an effective deterrent to speeding.

The area where the Bay Street camera installed is at a curve where there are approximately 100 car accidents per year. Police hope that the installation of the camera will reduce accidents.

95-year-old woman found dead after wandering away from care facility in Des Moines

The Des Moines police department is investigating the death of a 95-year-old nursing home resident who went missing on Monday night. Helen Jensen, age 95, was found dead about 100 yards from the nursing home where she lived.

According to a report on King5.com, Jensen went missing from the Wesley Homes Health Care Center about 11:30pm Monday night. Staff at Wesley did not call the police until about 2:30am. Police searched for Jensen about 45 minutes before they found her lying on the ground about 100 yards away from the nursing home at 100 S 216th Street in Des Moines.

Police looked at video surveillance tapes and saw that Jensen had left the nursing home in her wheel chair at about 11:45pm.

The King County medical examiner has not yet determined Jensen's cause of death. Temperatures in the Seattle-Bellevue-Tacoma metropolitan area have been below freezing for the last few nights.

If Jensen died of exposure or hypothermia, which is the death of someone who was exposed to extreme temperatures, this may be a case of nursing home neglect.

Families whose loved ones have died because of nursing home neglect may have a valid wrongful death claim. 2 Yakima women hit in pedestrian accident, one dies

Two pedestrians were hit by a car while crossing Nob Hill Boulevard at 11th Avenue on Tuesday evening reports The Yakima Herald.com. Brittny Kilpatrick, age 20, died of her injuries on Wednesday at Yakima Valley Memorial Hospital. Her companion, Sarah Nelson, age 22, suffered minor injuries in the pedestrian accident.

The two women were in an unmarked crosswalk when they were hit by a Nissan Maxima driven by Monica Barajas, age 20, of Yakima. According to the report, a vehicle in the inside lane stopped for the pair but the Maxima in the outside lane continued and hit the pair.

Police are investigating the pedestrian accident but they do not believe that alcohol or drugs were involved. Vehicle Code RCW 46.61.235 specifies that all vehicles must stop at an unmarked or marked crosswalk when a pedestrian or bicycle is upon or within one lane of the half of the roadway upon which the vehicle is traveling.

Candles pose home fires danger says Washington State Fire Marshal

The Washington State Fire Marshal, Esther Hernandez, reports that last year there were 133 home fires caused by candles in the state. Christmas Day, Christmas Day, Christmas Eve, New Year's Day and New Year's Eve are the top four days for home fires caused by candles. So far in 2009 there have already been 63 candle-caused fires in the state.

State Fire Marshal Mike Matlick provides the following information about the causes of home fires caused by candles and some provides some safety tips:

  • Have an adult supervising the flame
  • Don't fall asleep when using candles as that is a factor in 26% candle fire deaths
  • Don't use candles in sleeping areas as 40% of home candle fires originate in bedrooms
  • Place candles in sturdy and fireproof metal, glass or ceramic holders
  • Do not place candles where they can be easily knocked over
  • Keep candles out of reach of small children
  • Do not put candles on Christmas Tree

Amby baby bed hammocks recalled after two babies die

The Consumer Product Safety Commission in cooperation with Amby Baby Motion Beds/Hammocks have issued a voluntary recall of Amby Baby Motion beds after reports that two babies died in the hammock over the summer. According to the media release, both babies suffered suffocation deaths, one was a 4-month old girl from Lawrenceville, GA; the other a 5-month old boy from Gresham, Oregon.

The Amby Baby Motion bed has a steel frame with a soft fabric hammock. The hammock is attached to the steel frame with a spring. Because the hammock moves from side to side, babies can either roll out or shift against the hammock's sling or mattress causing suffocation.

The CPSC advises consumers stop using the product immediately and to contact Amby Baby USA for a repair kit at 866-544-9721.

2 Ridgefield, WA firefighters killed in Montana truck accident

The Seattle Times reports that two firefighters from Ridgefield, Washington were killed and another passenger -- a 14-year-old boy -- was critically injured in a single-vehicle accident in Montana when the truck they were driving went off a bridge near Butte. Killed in the accident were Douglas Ray Jacobsen, 49, and his front seat passenger, Richard Daniel Streissguth, 45.

According to the report, Jacobsen was driving a Ford F-350 truck and pulling a trailer when he hit a guardrail and the trailer jackknifed and pushed the truck off a bridge. The truck landed upside down. The men were in Montana to pick up an antique fire engine.

The Montana State Patrol believes the weather and icy roads were a factor in the truck accident. Trooper Tammy Perkins said that speed may also have been a contributing factor.

There has been a spate of car accidents in Seattle over the weekend as a a cold front with freezing temperatures has moved into Western Washington. The best advice we can give motorists is to slow down.

Man killed in Blaine hit-and-run pedestrian accident

The Washington State Patrol is looking for a vehicle that hit and killed a 54-year-old Blaine man as he walked on Highway 548 early Saturday morning near Blaine around 2:50am reports Seattle's KOMO News.com.

According to the report, the pedestrian accident occurred just south of Birch Bay Lynden Road. Blaine is a city near the Canadian border about 111 miles north of Seattle along Interstate 5.

Hidden granny cam helps convict nursing home aide for abuse

Johnetta Dashaw Phillips, age 30, was sentenced to 20 months in jail for felony abuse in a plea agreement after a "granny cam" caught her on video tape abusing a paralyzed stroke victim in the nursing home where she worked reports the Lufkin Daily News.com.

According to the report, the victim's husband installed the camera after his wife complained of nursing home abuse. Because of the woman's dementia, she was not able to identify who abused her. The hidden camera caught Phillips abusing the elderly patient several times including two occasions in which she roughly put the woman in her bed allowing her head to strike the headboard.

Phillips at first denied abusing the patient. When confronted with the videotape evidence, she then blamed the abuse on the victim and reported that the victim had hit her. The evidence, however, showed that the abuse was unprovoked.

The report said that Phillips will have to serve her entire 20 month sentence.

Poulsbo woman killed in pedestrian accident when Kitsap Transit bus hits her

A female pedestrian, identified as Annette Gobin age 49 or Poulsbo, was killed on Wednesday evening after a Kitsap Transit bus struck her. The pedestrian accident occurred on State Route 305 at Johnson Way around 7:30pm reports The Kitsap Sun.

According to the report, Gobin tried to cross the highway and stepped in front of the oncoming bus and there was nothing the bus driver could have done to prevent the accident.

As is routine in accidents like this, the bus driver was administered a breath analyzer test for alcohol but he passed. The Washington State Patrol does not believe alcohol or drugs were a factor in the accident.
