Seattle Lake Union boat explosion and fire injures two

An explosion and fire on a 30 foot long cabin cruiser tied to a fuel dock at the Westlake Avenue marina in Seattle injured one person, sending them to Harborview Medical Center in Seattle for treatment. Another person was also injured but did not have to be hospitalized.

According to a report in The Seattle Times, the explosion occurred late Saturday morning as the Uniflite boat, was docked at Morrison's North Start Marine Fuel on Lake Union's west shore. After the explosion, people at the fuel dock quickly chopped the line and pushed the boat away from the dock. The boat drifted into another boat which sustained some damage.

It is unclear whether the people that were injured were on the boat or on the dock. The boat had fire damage to its deck and cabin area. Harbor police have towed it to a police facility.

Forks logger injured in logging accident

The Forks Forum reports that a logger, Michael Bos, age39, has been upgraded from critical to serious condition after a logging accident in which he was struck by a log off of the 9000 logging road system, 17 miles northwest of Beaver, Washington.

According to the report, Bos was unconscious after he was struck and he suffered injuries to his shoulder, back and head.

The Clallam county Sheriff's Deputies and Quileute Fish & Wildlife Enforcement responded to the accident and a U.S. Coast Guard Helicopter took Bos to an Airlift Northwest Helicopter in Port Angeles which took him to Harborview Medical Center in Seattle.

The Washington State Department of Labor and industries (L&I) is investigating the accident. According to the L&I, logging is the most dangerous industry in Washington State. In twenty percent of logging accidents, defective equipment is the cause of the accident. Lack of training and risk taking are other causes of accidents. Chain saws and logging machines pose hazards and loggers use these tools in tight spaces and on rough terrain. Falling objects are also hazardous with branches, limbs and trees falling on loggers and also logs falling off logging trucks. Environmental conditions can also be extreme in Washington State which can cause logging to be more treacherous because of the threat of lightening.

Logging injuries can include eye injuries, multiple fractures, amputations, traumatic brain injury and spinal cord damage.

23 year old man injured in Bellevue construction accident

KIROTV.com reports that a 23-year-old man worker suffered injuries to his legs in a construction site accident in Bellevue this morning.

The construction accident occurred at Main Street and 110th Avenue Southeast. It appears as if a wall may have fallen on the man. He was taken to Harborview Medical Center in Seattle for treatment. His condition is unavailable at the time of this writing.

Firefighters with hearing loss win suit against siren company

Nine fighters have won a civil lawsuit against Federal Signal Corporation, a distributor of lights and siren systems for fire trucks reports the Chicago Tribune. In the civil suit, the firefighters said that their hearing loss was noise-induced and caused by the fixed volume sirens on fire trucks, engines and ambulances.

While the results of the recommended award was not made public, this seems to be one of the first successful suits brought on behalf of firefighters against the company.

Federal Signal says they will appeal the verdict and says it plans to aggressively fight to overturn the results of the verdict.

Pasco man and passenger injured in I-82 rear-end car accident

A Pasco man, Joseph Garcia, age 66, and his unidentified passenger were injured in a car accident when Garcia rear-ended a semi-truck that he was following on I-82 near the Oregon border.

According to a report on KNDO/KNDU.com, Garcia and his passenger were taken to Lourde's Medical center in Pasco for treatment of injuries.

Garcia's car was totaled. The driver of the semi-truck was not injured.

Spokane man to be charged with theft for conning senior citizens across Washington

A Spokane man, James Schmidt, age 50, will be arraigned on charges of first degree theft after allegedly conning senior citizens of more than $100,000 during the past year all over Washington state including in Yakima, Kittitas and Whatcom counties according to the Washington State Patrol media release.

Schmidt was a door-to-door salesman selling vacuum cleaners and air filters. Charging papers say he would gain the confidence of elderly persons and con them into lending him money or investing in a franchise.

Schmidt was convicted of a similar scheme in January of 2008 in King County.

Washington woman injured in bizarre accident at Grand Prix Raceway asks for new legislation

Faye Brown, who had part of her scalp ripped off in a bizarre accident at Grand Prix Raceway in Lakewood back in January of 2007, is asking Washington State legislators to require protective guards be required over moving parts on amusement park rides.

Brown suffered severe injuries to her scalp and became bald after her pony tail got caught in the rear axle of a go-cart she was driving. After the accident, Grand Prix Raceway installed protective guards and created signage regarding securing ones hair. The legislation sponsored by Senator Dan Swecker of Rochester would require protective guards be installed on all rides across the state.

Bellevue man injured when bungee cord breaks during jump

The Seattle Post-Intelligencer reports that Mark Afforde survived a 25 foot fall on Thursday when his bungee cord broke during a jump from the 200-foot high Canyon Creek bridge near Yacolt. Yacolt is located approximately 170 miles south of Bellevue near Vancouver, Washington.

seattle accident lawyerAccording to the report, Afforde landed in shallow water under the bridge and was able to walk after the accident. He was taken to Southwest Washington Medical Center in Vancouver where he is said to be in satisfactory condition.

Afforde says he'll bungee jump again.

Spokane Community College instructor and coach killed in freak bowling alley accident

The Seattle Times reports that Erik Anderson, 38, was killed in a freak bowling alley accident when he was attempting to dislodge a bowling pin from the basement bowling alley at Spokane Community College. According to the report, Anderson's neck was broken by the machinery and he apparently died instantly.

Anderson was a popular running coach and instructor at Spokane Community College. He was teaching a bowling class when the accident occurred around 11:30 am on Thursday.

Athletes and students at the college were devastated by the loss of the popular track coach and teacher. Anderson leaves behind a wife and two young daughters.

The report said that there was a common problem with pins getting jammed at the bowling alley. The Washington State Department of Labor and Industries is investigating the cause of the accident.

Redmond, Washington construction worker killed in construction accident at Microsoft campus

A construction worker was killed in an accident at a construction site today on the Microsoft campus. The worker was a man in his mid-30s and he suffered massive head injuries.

According to King5.com, the accident happened at the site of a parking garage under construction. The construction site was at 150th Avenue Northeast and Northeast 40th in Redmond. Apparently, a boom truck fell over on its side, crushing the man.
The Department of Labor and Industries is investigating the accident.

Jury awards man whose limbs were amputated $17.7 in MRSA infection malpractice lawsuit

A Dallas jury has awarded a man who lost his arms and legs due to a virulent staph infection he contracted while in a hospital for treatment of an ulcer a $17.7 million medical malpractice award. Doctors treated David Fritzgerald, age 53, with various antibiotics misdiagnosed the MRSA infection, a methicillin-resistant Staphylococcus aureus. A MRSA infection should be treated quickly and with the right medications or the patient can become septic. In Fritzgerald's case, he had to have his limbs amputated to save his life.

According to the Star Telegram, David Fritzgerald, was awarded $6.72 million in economic or compensatory damages. Economic damages are awarded to a plaintiff to compensate for the loss or injury for the harm suffered by another person's negligence. They cover loss of wages, medical care and future medical care.

Fritzgerald was also awarded $11 million for pain and suffering. Pain and suffering or general damages compensate the victim for the non-monetary aspects of his/her loss. These types of damages cover things the physical pain suffered, disfigurement, or loss of enjoyment of life. The State of Texas where Fritzgerald resides and where the case was tried has a cap on "non-economic" damages so the award was reduced from $11 million to $250 thousand. Fritzgerald's attorney called Texas' caps a "tragic unfairness."

The hospital and several doctors settled with Fritzgerald for misdiagnosis and negligent treatment prior to the trial but the civil suit against infectious-disease specialist Meenakshi Prabhakar proceeded and the jury found Prabhakar negligent.

House of Representatives passes HR 448 -- Elder Abuse Victims Act of 2009

The House of Representatives voted on February 11, 2009 to pass HR 448 which is the Elder Abuse Victims Act of 2009. The bill will now go on to the Senate for a vote. The Bill passed on a roll call vote and was passed overwhelmingly with 397 Ayes, 25 Nays and 10 not present or voting.

HR 448 was introduced to protect senior citizens from abuse by establishing elder abuse prosecution programs and also provides for aid for victims of elder abuse as well as specialized training for prosecutors, law enforcement and others to combat elder abuse.

Blaine, Washington chiropractor's license is suspended for "unprofessional conduct"

The Washington State Department of Health (DOH) reports that they, along with the Chiropractic Quality Assurance Commission, have suspended the license of Nicolas Constantin (license CH00034646). Constantin is not allowed to practice as a chiropractor in Washington until a hearing. Constantin has his practice in Blaine which is in Whatcom County.

Documents filed by a health care investigator says that Constantin admits to having used black tar heroin. The DOH says

"[Constantin]poses a risk of immediate danger, as there is no way to protect patients from the likelihood that harm might be committed by an impaired practitioner."

The reasons for the license suspension also include a charge of driving under the influence (DUI), a conviction of fourth-degree assault for hitting his wife, and a conviction for violating a no-contact order. A "no contact" order specifies that a person is not able to call, write or otherwise contact a third party. Constantin was convicted of violating a no-contact order with his wife.

Washington Supreme Court rules woman cannot be held liable as an accomplice in DUI case

The Washington State Supreme Court has upheld an Appeals court ruling saying that a woman cannot be liable as an accomplice in a driving under the influence (DUI) case as she was a victim in the accident that killed her fiancé and five friends.

The case stems from a horrific accident that occurred in 2001. Teresa Hedlund, who was 28 at the time, held a party at her home where she served alcohol. When the party ended, Hedlund, her fiancé and five other young people all piled into a car with Hedlund's fiance, Tim Stewart, driving. Hedlund videotaped the group joking and clowning in the car. Stewart drove recklessly and the car plowed into a freeway concrete support post. Hedlund was the only survivor. Stewart's blood alcohol limit (BAC) was later found to be twice the legal limit at the time of the accident.

Hedlund was convicted in 2003 in Auburn Municipal Court of encouraging drunken driving and providing alcohol to minors as one of two of the underage assengers in the car drank at the party. The Auburn court ruled that she was an accomplice to DUI since she served the alcohol and she also encouraged Stewart's reckless behavior by videotaping him while he was driving. Hedlund appealed the conviction saying that she could not be convicted of being an accomplice to DUI as she was a victim of herself. The crux of the case was the definition of the word victim. In 2007, the State Court of Appeals overturned the lower court ruling. On Thursday, the State of Washington Supreme Court affirmed the Appeals Court decision, ruling in a 5-4 decision.

"The Legislature has declared, 'A person is not an accomplice in a crime committed by another person if: (a) He is a victim of that crime,' " said Justice Tom Chambers, writing for the majority.

First officer in Buffalo plane crash was recent Central Washington University grad

The 24-year-old First Officer of the Continental Airlines flight 3404 that crashed in Buffalo, New York, on Thursday was from Maple Valley and was a recent graduate of Central Washington University (CWU) in Ellensburg.

The CWU web-site says that the Department of Aviation is taking the death of Rebecca (Morris) Shaw "pretty hard." Shaw graduated from the Department of Aviation program in 2007. She received a Bachelor of Science in flight technology with a minor in philosophy. Prior to attending Central, she attended Big Bend Community College.

Parents file $20 million wrongful death suits against State for son's death at Western State Hospital

The parents of a mentally ill young man who committed suicide while a patient at Western State Hospital have filed wrongful death lawsuits against the State of Washington reports The Seattle-Post Intelligencer. Western State Hospital is a mental health hospital located on Steilacoom Boulevard in Tacoma.

Marcos and Phyllis Gordon of Montesano, located in Grays Harbor County, are asking for $20 million in damages and their suits claim that the psychiatric hospital did not do enough to protect their son, Anthony Gordon, 27. Gordon was admitted to the hospital by court order and was experiencing hallucinations and suicidal thoughts at the time of his commitment. He hung himself with a bed sheet in January of 2008.

The Gordons also claim that the staff at the hospital falsified a report in a an attempt to conceal their mistakes.

Cougar Mountain Baking Co. of Seattle recalls cookies due to peanut salmonella scare

The Seattle Post-Intelligencer reports that Cougar Mountain Baking Co., based in Seattle, is another company voluntarily recalling products due to the recent salmonella outbreak caused by peanut products distributed by the Peanut Corporation of America. They are recalling boxes of their Gourmet Cookies that contain peanuts or peanut butter. They are also recalling a cookie dough product.

No illnesses have been linked to products distributed by Cougar Mountain in stores in Washington, Oregon, California and New York and also distributed through mail-order.

Seattle man dies after fall from Las Vegas hotel window

A Seattle man, Jeffrey F. Kamota, age 21 died after a fall from a Circus-Circus hotel room window in Las Vegas, Nevada reports The Seattle Times. According to the article, Kamota died from fall injuries around 3am on Thursday. Speculation is that he leaned out the eighth story window to smoke.

Oregon State Judiciary Committee may raise lawsuit limits in government negligence cases

The Seattle Post Intelligencer reports that the Oregon State Judiciary Committee has approved Senate Bill 311 which allows juries to award victims who sue the State or local government for damages caused by government negligence to a larger award.

Senate Bill 311 was brought about after a 2007 Oregon Supreme Court ruling found that a $200,000 damage award for medical malpractice was insufficient to care for a boy who suffered a traumatic brain injury at Oregon Health and Science University.

Senate Bill 311 proposes that damage caps will increase $100,000 a year to a maximum of $1.5 million. In addition, awards will no longer distinguish between economic and non economic damages (commonly known as pain and suffering).

The article says that cities, counties, school boards and special districts are not affected by Senate Bill 311.

Washington Governor Chris Gregoire serves jury duty

Even Washington Governor Christine Gregoire was called to serve jury duty. Gov. Gregoire served on Monday at Thurston County Superior Court. She was called for a criminal case involving theft, forgery and bail jumping.

Gov. Gregoire was in the prospective juror pool but she was not called to serve and she went back to work in the governor's office after she was dismissed.

It is good to see the Governor performing her civic duty.

People are called to serve for jury at random based upon voter registration and driver's license in Washington State. Once you've been selected, you are mailed a questionnaire that makes sure you are eligible to serve. To be eligible you must be 18, a citizen, a resident in the county you've been called to serve in and you must be able to speak and communicate in English. If you have a felony conviction, you must have had your civil rights restored.

Department of Health suspends Burien dentist's license

The Washington State Department of Health has suspended a Burien dentist's license for failing to property test sterilization equipment used to disinfect dental instruments. According to a press release, the Department of Health says that the dentist, Parivash Khajavi, put staff and patients at risk.

The license suspension prohibits Khajavi from practicing dentistry until a hearing is made in the case. Khajavi has 20 days to respond to the charges.

Khajavi operated Burien Family Dentistry. The charges say that Khajavi failed to conduct biological spore testing on the sterilizing equipment throughout 2008.

Kent manufacturer recalls milk chocolate peanuts due to salmonella fears

The Seattle Times reports today that Crown Pacific Fine Foods of Kent, Washington is recalling their sugar free milk chocolate peanuts because the peanuts used were recalled by Peanut Corporation of America. The Peanut Corporation of American is a Georgia-based company whose peanuts products have been associated with a recent outbreak of foodborne illness.

The Food and Drug Administration has linked an outbreak of Salmonella Typhimurium illness to peanut butter and peanut paste produced by the Peanut Corporation of America (PCA) at a processing plant located in Blakely, Georgia. The FDA found the same strain of Salmonella Typhimurium associated with illness in an unopened container of peanut butter which indicates that the peanut butter was contaminated at the processing plant. To-date, illness has only been linked to peanut butter and peanut paste, not peanuts.

foodborne illness ecoli salmonella seattle lawyerThe milk chocolate peanuts produced in Kent were distributed by the Houghton Market in Kirkland in 5-pound bags. The brand name is Koppers, Sugar Free Milk Chocolate Peanuts. There are no known illnesses due to this product.

The PCA salmonella outbreak has sickened more than 500 people in 43 states and at least one death has been connected. The family of a 73-year-old woman who died has filed a wrongful death lawsuit against the Peanut Corporation of America. Salmonella is a bacterium which can make people ill with severe stomach cramps, diarrhea and high fever. In severe cases, it can cause death.

Child injured in Marysville pedestrian accident

Details are sketchy but the Everett HeraldNet.com reports that a child was airlifted to Harborview Medical Center in Seattle after being hit by a vehicle at the intersection of 55th Avenue NE and 95th Place NE around 2:40pm in Marysville.

Police are investigating the pedestrian accident.

Sunset Highway car accident injures 7 near East Wenatchee

A two-car accident injured seven people on Sunset Highway just north of East Wenatchee on Friday afternoon. According to a report in the Wenatchee World, a car 1998 Chevy pickup truck driven by Adnan Abouammo, age 51, of East Wenatchee and a 2004 Kia Sedan driven by Robert Ivy, age 32, or Monroe collided at Blue Rock Drive Northeast and Sunset Highway.

Passengers in Abouammo's truck were Ramiah Abouammo, age 23, Lilli Olin, age 14 and Shelby Hayes, age 14 all of East Wenatchee. Passengers in Ivy's Kia were Nancy Ivy, age 31, and Taylor Ivy, age 7, both of Monroe.

All seven people involved in the car accident were taken to Central Washington Hospital in Wenatchee for treatment of unspecified injuries.

The Sunset Highway is a heavily traveled corridor with nearly 15,000 vehicles traversing the highway daily. Congestion and safety hazards have plagued the highway.

Spokane court charges mother with vehicular homicide in baby's car seat death

A Spokane County prosecutor has filed charges of Vehicular Homicide in Spokane County Superior Court against Eileen Jensen of Post Falls, Idaho in the car accident death of her infant daughter. According to a report on Seattle's King5.com, Johnson was involved in a rear-end car accident and her baby daughter was in a rear-facing car seat in the front seat of the vehicle. The car's air bag went off, injuring Jensen's daughter who died 10 months later. Jensen will be arraigned February 18.

In the first case of this kind in Washington State, Vehicular Homicide can be charged in cases where a driver was under the influence of alcohol or drugs, was driving recklessly or was driving without the regard of safety of others and someone is killed or succumbs to their injuries within three years of the accident. The Deputy Spokane County Prosecutor, Mary Ann Brady, says that the death of Jensen's daughter "fits the criteria" for the charge of Vehicular Homicide.

Comments on the King5.com web-site, did not agree with the Prosecutor's office. Many people expressed that Jensen had been punished enough and that sentencing her to prison would serve no purpose.

Bicyclist sues Washington State asking for accident records for Seattle's Montlake Bridge

A bicyclist, Michael Gendler, has filed a lawsuit asking the Transportation Department and Washington State Patrol asking that they turn over accident statistics for the Montlake Bridge. Gendler is asking for the data which he hopes to use to prove that his bicycle accident, resulting in his paralysis, was due to a defect in the bridge design.

The Montlake Bridge carries State Route 513 over Seattle's' Montlake Cut and connects Montlake with the University District.

An assistant attorney General, Rene Tomisser, says that the records can not be released because it jeopardizes federal highway-safety funds.

Washington State Patrol announces DUI arrest figures for Super Bowl weekend

The Washington State Patrol (WSP) has announced their Driving Under Influence (DUI) arrest statistics for Super Bowl Weekend. Throughout the State, the Patrol arrested 125 drivers for DUI between midnight February 1, 2009, through 3:00 a.m. February 2, 2009 . Compare this with the previous weekend when the Patrol made only 75 DUI arrests during the same time frame. This is a 60% difference. In the greater Seattle area, 23 DUI arrests were made.

The Patrol, conducted DUI emphasis patrols throughout the State and targeted drivers who were speeding, driving recklessly or aggressively. By focusing on such drivers, the Patrol has found that they can get drunk drivers off of the street.

Over this past weekend, their was one alcohol-related motor vehicle death in the State.

Every year, there are approximately 18,000 people killed in alcohol-related car accidents in the United States. In Washington State, 45% of all traffic fatalities are alcohol-related.

Tour bus accident investigation underway

The Seattle Times reports that Department of Public Safety authorities are investigating the tour bus accident in Arizona on Friday around 4pm near the Hoover Dam that killed seven tourists from China and seriously injured 10 others including the bus driver.

The accident happened on Highway 93 after the tour bus was returning from a sight-seeing trip to the Grand Canyon from Las Vegas. Apparently the bus rolled at least once and the dead were thrown from the bus.
