Woman suffers head injuries after falling 2 stories from WSU fraternity fire escape

The Seattle Times reports that a woman underwent surgery at a Spokane hospital after she suffered head injuries when she fell two stories from a Washington State University (WSU) Fraternity fire escape in Pullman.

The accident occurred around 2am Sunday morning at the Theta XI fraternity house. The woman told police she thought the fire escape had stairs instead of a ladder. Police say no alcohol was involved.

90% of nursing homes cited for health violations

The Department of Health and Human Services (DHHS) reports that more than 90% of nursing homes in the United States were cited for violating federal standards every year for the past three years according to an article in The Seattle Times. The DHHS report also cites statistics which shows that for-profit facilities have a higher percentage of violations than those run by non-profit organizations or government entities.

Almost 20 percent of the nursing homes lacked the essential elements of care so that patients were in immediate jeopardy or experienced actual harm said the report by Daniel Levinson, the inspector general of the Department of Health and Human Services. The most common violations included improper storage and distribution of foods, accident hazards, lack of services, medication errors, infected bedsores, poor nutrition and abuse and neglect.

More problems are being identified while at the same time the level of care may be improving because of pressure from Medicare, the press and lawsuits.

Jury awards homeowners $130 M in Farmers Insurance 'bad faith' and 'breach of contract' suit

Los Angeles based Farmers Insurance, a subsidiary of Zurich Financial Services, has lost a $130 million jury verdict to homeowners who alleged the company breached their contract and showed bad faith and fraud in underpaying on claims. The company failed to pay contractors for overhead and profits.

The class action suit contained 76,000 people who averaged $575 in unpaid bills.

A Lawton, Oklahoma jury awarded the homeowners $50 million for breach-of-contract, $50 million for bath faith and $30 million in punitive damages.

According to The Los Angeles Times, this is the 14th largest Jury Verdict in the U.S. this year.

Farmers is appealing the award.

Woman killed in Lake Washington boating accident was teacher for Bellevue School District

The Bellevue school district spokeswoman, Ann Oxreider, said the 37-year-old woman killed in a boating accident on Saturday evening on Lake Washington was a teacher for the Bellevue School District. The Seattle Times identifies the woman as Heather DeHart of Bothell who was a music teacher at Tyee Middle School in Bellevue.

The accident occurred on Saturday evening when a motorboat driven by a 17-year-old young man crashed into and over a sailboat that was at anchor according to KOMOTV.com, killing the woman and injuring two passengers on the sailboat. The driver of the motorboat and his 16-year-old female companion also suffered minor injuries.

Crash investigators said the sailboat may have been speeding at the time of the collision. It is unknown whether the motorboat saw the sailboat and if the sailboat had any lights on. The sailboat passengers tried to wave the motorboat to slow down and they shouted "Stop! Stop! Slow down!" according to Police Spokeswoman Renee Witt.

If it is found that the young man was speeding, he could be charged with Vehicular Assault and Vehicular Homicide. A driver of a motor vehicle can be charged with Vehicular Homicide if a person dies as a result of negligent operation of a vehicle and that includes driving recklessly.

Everett man killed in construction accident after crate falls on him

The Everett HearaldNet.com reports that a 35-year-old man was killed in a construction accident when a 1,000 ton crate full of glass fell onto him. The man and another worker were moving the crate at the time.

The accident occurred at 6:25pm at a manufacturing plant in the 11800 block of Beverly Park Road according to the report.

Firefighters responded quickly to the accident and, with the help of some of the workers, they were able to free the man from under the crate. However, the man died at Providence Regional Medical Center in Everett a short time later.

According to the U.S. Department of Labor Statistics, approximately 87 workers were killed on the job in 2006. More than 50% of th eaccidents occur to people under the age of 45.

Kitsap county man killed in construction accident

A 26-year-old Seabeck, Washington man has died after a construction accident near Southworth in Kitsap County. The man was helping install a large tank at a home when the excavator holding the tank, tipped over and buried the man according to The Seattle Times.

The man was uncovered and flown to Harborview Medical Center in Seattle where he died about five hours later.

The man worked for Cleaver Construction of Kingston. The company's specializes in septic design, materials trucking and stump grinding.

E-coli bacteria found in Lake Symington area of Kitsap County, Washington

Approximately 600 homes in the Lake Symington area, west of Bremerton, have been advised to boil their tap water because West Sound Utility District has detected E-coli in the water according to the Kitsap Sun.

Affected homes are between Holly Road on the south, Larson and Glory lanes on the north, Big Beef Crossing on the east and Coho Run on the west.

E-coli was found during routine water sampling tests. The cause is unknown and crews are working to determine the cause and will disinfect the water system.

Residents are advised to boil their water for at least one minute or use bottled water for personal hygiene, drinking, food preparation, dish washing and making ice.

Nursing home neglect: a nurse's story

Most nursing home employees are professional and caring. A lot of times, however, because of the for-profit nature of the nursing home business, patients are neglected because the nursing home is understaffed.

Understaffing can be a real problem in nursing homes. One result of understaffing is falls that occur because patients tire of waiting for someone to help them out of bed to use the bathroom. Another result is mistakes in distributing medications.

One Blog we came across is "Nursing Home Reality" and it contains stories by nurses and nursing home professionals who share their story in hope of "creating positive change." A recent posting caught our eye, An Inside View of UNDERstaffing. It was written by a registered nurse working in a nursing home. It illustrates the problems of short staffing.

"I am an RN in a nursing home licensed for just over 200 residents that offers skilled, intermediate and personal care. This facility has four nurses stations/units. I work on a unit with 38 residents. Many of these individuals have dementia.

My unit is allowed four nurses aides and an LPN on day shift, 3 nurses aides and an LPN on evenings, 1 - 2 aides and an LPN on nights.

While I try hard to understand the “budget” for staffing on my unit, my repeated requests for additional help has been ignored. In August I had eight (8) resident falls on my unit and they all happened on evening shift. My unit’s LPNs are frequently out of time compliance on distributing medications.

I would like to see mandatory staffing based not only on the number of residents, but also on their needs. This is especially important on a unit that has residents with many needs."

Thurston County emergency responders sued for malpractice in boy's death

On July 4, 2007, a family celebration turned into tragedy when a cannon that was fired sent shrapnel flying and fatally injured an 8-year-old boy, Devan Vyborny, of Olympia.

Now, Devan's parents are suing Thurston County emergency responders saying that their Medic One personnel were slow to respond, negligent in their duties and lacked professional conduct reports KOMONews.com. In the suit, the parents claim that "witnesses observed that the Medic One personnel appeared overwhelmed." They also claim that the 911 operator canceled a helicopter airlift for the boy.

This blog reported an incident that was very similar to the accident that killed Vyborny this past 4th of July. In this year's accident, three people suffered serious injuries due to flying shrapnel.

American Airlines plane from Seattle skids off runway in Chicago

KiroTV.com reports that American Airline Flight 268, which left Seattle at 7:42am on Monday flying to JFK International airport, diverted to Chicago's O'Hare International airport after indicator lights alerted pilots to a potential problem.

The plane made an emergency landing at O'Hare where a tire blew out and the Boeing 757 overran the runway.

The Federal Aviation Administration and American Airlines reports there were no injuries.

Proposed Washington State laws to prevent elder abuse

The Seattle Times reports that recommendations by experts in the law enforcement, social work and financial services fields have helped develop some proposed laws for Washington State which would help authorities in identifying, preventing and prosecuting people who harm and abuse some or our most vulnerable citizens, the elderly and infirm.

The Times reports that there are 13,000 abuse reports to Washington State agencies a year involving senior citizens.

Attorney General Rob McKenna initiated the effort to create these laws because he has seen a "steady increase in the frequency with which fraud-related cases involve the exploitation and abuse of older adults."

Laws proposed to the State Legislature include:

  • Increasing punishment to those that harm people 65 years of age and older.
  • Requiring people in financial institutions to report anyone they suspect of exploiting the elderly financially.
  • Improving coordination between Adult Protective services and law enforcement.
  • Providing a database where people can search for the names of those who have a history of elderly abuse.

Two United State Senate bills were just approved by the Senate Finance Committee. One bill, "Elderly Justice Act" resolves to "prevent, detect, treat, intervene in, and prosecute elder abuse, neglect, and exploitation." The other "Patient Safety and Abuse Prevention Act of 2007" provides background checks and criminal screening for nursing home employees who work directly with patients.

Medical malpractice in children may have more serious consequences than in adults

Medical mistakes in treating children may cause more serious problem then in adults says a health report in the New York Times. Because children have immature immune systems and lower body weights they be react more severely to medication errors and infection.

The Times article cites a study in Pediatrics journal which reports that medication problems in children occur to 11% of the children admitted to a hospital. Children are also victims of diagnostic errors which can result in "serious complications or death." Children are often are unable to communicate their symptoms or medical professionals may misjudge a patient for having a tantrum or nerves when the child is displaying acute symptoms of discomfort. One malpractice study found that in the Emergency Room, physicians were most likely to miss symptoms of meningitis, appendicitis and broken arms.

Prescription errors can occur in the hospital and at home. In adults, many medications come in a pre-packaged standardized dose. In children, the medication more often have to be formulated and measured and this is where pharmacists can make mistakes.

Experts tell parents with a child in the hospital to be vigiland and:

  • Make sure your child always has their ID bracelet on
  • Make sure all health care providers wash their hands
  • Make sure all members of the surgical team knows exactly what the procedure is
  • Review your child's condition with their physician and nurses daily
  • Keep an eye on IVs, catheters and incision, looking for any sign of infection or misplacement
  • Ask questions about diagnosis and treatment
  • Keep your own records including medications and allergies
  • Double check orders and double check the medications and dosages your child is given

Two Senate Bills seek to protect nursing home residents from Elder Abuse

Two important bills for residents of nursing homes have just been approved by the Senate Finance Committee. Both bills seek to prevent nursing home neglect and abuse.

S. 1070 known as the "Elder Justice Act" amends the Social Security Act and resolves to "prevent, detect, treat, intervene in, and prosecute elder abuse, neglect, and exploitation."

Senate Bill S. 1577 the "Patient Safety and Abuse Prevention Act of 2007" requires screening, including a national criminal history background check, of employees who work directly with patients in nursing homes, long care facilities and other nursing facilities for our elderly citizens.

While most nursing homes are staffed with professionals, these bills try to insure that any one with a violent, sexual deviant or criminal history not be allowed to work with our most vulnerable citizens.

Abuse can take many forms but common symptoms of abuse include physical abuse, sexual abuse, bedsores/pressure sores, broken bones, dehydration, pneumonia, frequent urinary tract infections, and over prescribing.

Toddler dies after being strangled by soccer net

The Consumer Product Safety Commission has recalled 190,000 MacGregor and Mitre folding soccer goals after a young child became entangled in a net and was strangled to death. The agency recalled the goals, distributed by Regent Sports Corp. of Hauppauge, N.Y and sold nationwide, because they say the netting has dangerous sized gaps; The gaps in the net are 20 inches square and they should be less than 17 or greater than 28 inches.

Pit bull attacks Moses Lake 6 year old

The Seattle Post Intelligencer reports that a 6 year old Moses Lake boy, Alex Medina, was airlifted to Harborview Medical Center in Seattle and is in serious condition after being attacked by a neighbor's pit bull last Friday.

Medina suffered serious injuries to his face, scalp and ears. According to the report, Medina was in his own backyard when the dog entered and attacked him. His mother and some relatives pulled the dog off of the boy.

Medina was first taken to Samaritan Hospital in Ephrata before he was moved to Harborview.

This attack came a week after Huong Le, 71 of SeaTac suffered severe injuries after a vicious attack by two pit bulls running loose in her neighborhood. In that horrific incident, police killed the two dogs and confiscated two others owned by the same man.

Le suffered serious injuries with dog bite wounds all over her body, her ears were torn off and had to be re-attached and she suffered a broken wrist or arm.

In August, we reported on a Federal Way girl attacked and bitten by a pit bull when she was dropping off a business card on its owner's front porch.
